The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. ยง 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education.
When Fenton is used by a school, district, or teacher (collectively "School") as part of their educational program, certain data collected by Fenton may be considered part of the student's "education record" under FERPA. Fenton is committed to acting as a "school official" with a "legitimate educational interest" under FERPA when providing services to Schools, subject to the terms of our agreement with the School.

Parents wishing to exercise these rights should contact their child's School directly. Fenton will assist Schools in meeting their FERPA obligations regarding data maintained within our service.
We implement reasonable security measures to protect education records. Data is retained only as long as necessary to provide the service to the School or as directed by the School, consistent with FERPA and applicable agreements. Data is securely deleted upon request by the School or at the end of the contract term.
